Terms of Service

Acceptance of Terms
By creating an account or using the CasePilot360 platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. The Platform is operated by CasePilot360.
Description of Service
CasePilot360 provides digital tools to help parents and guardians understand their rights under the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act. The Platform includes educational content, document templates, goal and accommodation tracking, meeting preparation tools, and document storage ("Advocacy Binder"). CasePilot360 is a technology platform. It is not a law firm or an advocacy agency and does not provide legal advice or advocacy services. Independent advocates may use the Platform to serve their own clients. They are not employees, agents or partners of CasePilot360, and any services they provide are an arrangement solely between you and that advocate.
Account Registration
You must be at least 18 years old and the parent or legal guardian of the child whose information you enter. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information during registration and to update it as needed.
Subscription Plans and Payment
The Platform offers a Free plan and two paid parent plans, Prepared ($24.99 per month) and Prepared Pro ($49.99 per month), and advocate plans for advocates (Solo, Practice and Agency, each billed monthly or yearly at the price shown on our advocates page and at checkout). Paid subscriptions are billed by card, monthly or, for a yearly plan, once a year, through our payment processor, Stripe, and renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
Credits under the advocate plans. Each advocate plan includes a set amount of credits in each calendar month, shown on our advocates page and at checkout. Credits are used when you, or the families you sponsor, use the assistant and the document tools, and each use is measured at our cost. By accepting the payment authorization at checkout you authorize CasePilot360 to charge the card on file automatically, and without further notice, for credits used beyond the included amount, at our cost, up to a monthly ceiling we set. We charge each time the unbilled amount reaches a set threshold and once more after month end for any remainder. If a charge fails, the assistant pauses until it is paid, and you can withdraw this authorization at any time from your dashboard, after which the assistant stops when the included credits are used.
Sponsored families. A family that signs up with an advocate's join code receives Prepared Pro at no charge for as long as that advocate's license is active. If the license ends, sponsored families return to the Free plan.
Free Tier Limitations
The Free plan supports one child per account. Features including the Know Your Rights guide, jargon translator, starter questions, and limited Advocacy Binder storage (5 files) are included. Additional children, advanced features, and expanded storage require a paid subscription.
Acceptable Use
You agree to use the Platform only for its intended purpose: to support your family's advocacy for your child's educational rights. You may not:
- Use the Platform for any unlawful purpose
- Share your account credentials with third parties
- Upload content that is defamatory, harassing, or infringes on the rights of others
- Attempt to reverse-engineer, decompile, or access the Platform's source code
- Use automated tools to scrape or extract data from the Platform
- Resell, redistribute, or sublicense any content or tools from the Platform
Your Content
You retain ownership of all content you upload, enter, or create on the Platform, including your child's data, observations, and documents. By using the Platform, you grant CasePilot360 a limited license to store, process, and display your content solely to provide the Platform's services to you. We will never use your content for any other purpose without your explicit consent.
Intellectual Property
The Platform, including its design, code, educational content, letter templates, and tools, is the property of CasePilot360 and is protected by copyright, trademark, and other intellectual property laws. Letter templates are provided for your personal use in advocating for your child and may not be resold or redistributed commercially.
Limitation of Liability
To the maximum extent permitted by law, CasePilot360 and CasePilot360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim related to the Platform shall not exceed the amount you paid us in the twelve months preceding the claim.
Termination
You may close your account at any time by contacting support@casepilot360.com. We may suspend or terminate your account if you violate these Terms. Upon termination, we will delete your data in accordance with our Privacy Policy, and you may request an export of your Advocacy Binder data prior to deletion.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform at least 30 days before the changes take effect. Your continued use after changes are posted constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. You and CasePilot360 agree that any dispute arising out of or relating to these Terms or the Platform will be brought exclusively in the state or federal courts located in or serving Collin County, Texas, and you consent to the personal jurisdiction of, and venue in, those courts.
